Construction Manager-At-Risk and RFP

REQUEST FOR PROPOSALS FOR CONSTRUCTION MANAGER-AT-RISK:

SMITHVILLE INDEPENDENT SCHOOL DISTRICT

Sealed proposals will be received by Cheryl Burns, Superintendent of Schools, Smithville Independent School District (the “District”), P.O. Box 479 and 901 N.E. 6th Street, Smithville, Texas 78957, until 2:00 p.m., Wednesday, December 19, 2018, at which time they will be publicly opened at the street address of 901 N.E. 6th Street, and the names of the offerors, and the fees and prices, if any, stated in each proposal read aloud as the proposals are opened, to provide Construction Management at-Risk (“CMAR”) services for the November 2016 Bond Program Construction Projects – the Miscellaneous Renovations to the Smithville ISD Elementary Campus and former Junior High Campus Project (“the Project”). The CMAR will be expected to provide services for the design phase, bid/award phase, and construction phase of the Project contracted. 

The budget for the Project (including all design fees and soft costs) is $5,500,000.00.  The total construction budget is estimated to be $4,125,000. 

The District has selected PBK Architects, Inc., as the Architect for the Project. 

The firm selected will provide the CMAR services for the Project, which includes interior renovations to both the Smithville ISD Elementary Campus and former Junior High Campus and improved ADA access.

The construction schedule is anticipated to provide for Substantial Completion of the Project:  July 2020 for use in the 2020-2021 school year.

The District currently anticipates that the Architect and the awarded CMAR will collaborate to develop the schedule for Schematic Design, Design Development, Construction Documents, Bidding & Negotiation and Commencement of Construction to meet the anticipated substantial completion date of July 2020.

The firm selected will be required to enter into a contract utilizing the Owner/Construction Manager Agreement, AIA Document A133-2009, Standard Form of Agreement Between Owner and Construction Manager as Constructor where the basis of payment is the Cost of the Work Plus a Fee with a Guaranteed Maximum Price, as modified by District, and AIA Document A201-2017, General Conditions of the Contract of Construction, as modified by the District, and to furnish Performance and Payment Bonds through an approved bonding company duly authorized to do business in the State of Texas and currently listed in the Department of Treasury Federal Register in an amount of not less than 100% of the contract price, conditioned upon the performance of the contract, provide insurance as set forth in the procurement package and contract, and meet all other requirements set out in the Request for Proposals and resulting contract.

Attention is called to required compliance with all Federal, State and local labor laws, including Chapter 2258, Texas Government Code, Title 10, and the prevailing minimum wage rates as set by the Smithville ISD Board of Trustees.

All parties acknowledge the right of the District to reject any or all of the Proposals and to waive any informality or irregularity in any Proposal received. By submitting a Proposal (or Proposals), each offeror agrees to waive any claim it has or may have against the District, the Architect and their respective employees arising out of or in connection with the administration, evaluation or recommendation of any Proposal; waiver of any requirements under the Proposal Documents; acceptance or rejection of any Proposal; and award of Contract.

Pursuant to the provisions of the Texas Government Code Chapter 2269, Subchapter F, it is the intent of Smithville ISD to select its CMAR via a ONE-STEP PROCESS.

There will be a pre-proposal meeting (it is not mandatory) on Tuesday, December 11, 2018 at 10:00 a.m. at 901 N.E. 6th Street, Smithville, Texas 78957.
